What Is a Personal Injury Claim?

A personal injury claim is a lawsuit filed in civil court to recover damages for losses stemming from an accident or incident caused by someone else’s negligence or wrongdoing. The purpose is to allow the injured party to be “made whole,” or compensated financially. Personal injury claims can arise from accidents, intentional acts, defective products, and other types of negligence.

After a serious injury that was someone else’s fault, call us at (725) 999-4050 to find out how we can help.

What Damages Are Available for Personal Injury?

In a Nevada personal injury claim, an injured party can seek compensatory damages—money designed to compensate that person for past and future losses. These may include:
  • Economic damages – such as medical expenses and lost wages; and
  • Noneconomic damages – such as pain and suffering.

In most cases, there is no limit set by Nevada law on the amount of compensatory damages you are allowed to recover in a personal injury claim. There is an exception for medical malpractice cases –noneconomic damages are capped at $350,000.
